As you move through the divorce process, you’ll pay close attention to the way things unfold with respect to child custody. While you may not get exactly what you want, that shouldn’t stop you from maintaining a good relationship with your children in the future.

While you hope that you and your ex are able to successfully co-parent in the future, you never know when things could take a turn for the worse. Should this happen, a modification is something to strongly consider.

Here are some circumstances that may lead you to consider requesting a child custody modification from the court:

  • Your ex is ignoring the parenting agreement that’s currently in place: You create a parenting agreement with the idea that it’ll guide you and your ex when co-parenting. For example, it should outline who has physical and legal custody. When your ex doesn’t follow this agreement, it’s much more difficult to stay on the same page.
  • Your children are in danger: If you have concerns about the safety of your children when spending time with your ex, it’s critical to take immediate action. For instance, this could come into play if your ex has become physically or emotionally abusive or is showing signs of a drug or alcohol addiction.
  • Your ex is moving away: Should your ex decide to relocate, such as for a job opportunity, it could throw your parenting agreement for a curve. This typically occurs when one parent moves a far distance away, such as another state or country.
  • The death of your ex: This will change your arrangement in a variety of ways. For example, if your ex had physical custody of your children, this responsibility may move to you.

If you have reason to believe that a child custody modification is in your best interest, start by reviewing the agreement that’s currently in place. This will give you a better idea of where things stand, along with the options that are available to you.

There’s never a good time to take a risk with the well-being of your children. If you think a child custody modification is necessary, don’t wait to take action.
