Understanding the Rights of Persons in Need and Their Caregivers

When a court determines that a person is unable to care for themselves, a court can appoint a guardian to make decisions for the incapacitated person. The court can appoint a “Guardian of the Person” to care for and assume legal responsibility for the incapacitated person. The court can also appoint a “Guardian of the Estate” to oversee the incapacitated person’s financial matters.  In Pennsylvania, incapacitation and guardianship matters are handled by the Orphan’s Court division.

Our attorneys have extensive knowledge of the Orphan’s Court system in Adams County. Attorney Luedtke is frequently appointed by the Adams County Court of Common Pleas to serve as Guardian Ad Litem in custody cases and in Incapacitation/Guardianship cases.
